Housing Society and Flat Transfer Questions
A frequent issue is the transfer of a flat or society share after the owner's death, or a disagreement among heirs or with the society. Depending on whether there is a will and a nomination, the society may ask for probate, letters of administration or other documents before transferring membership. Early advice helps identify the correct route and avoid delay.
A nomination with the society does not by itself decide ownership among the legal heirs. Each case depends on its documents and the applicable law.
Courts and Forums
- Civil and property disputes: The Bombay City Civil Court or the High Court of Bombay, depending on value. Certain disputes involving co-operative housing societies go before the Co-operative Court.
- Family matters: The Family Court at Bandra.
- Criminal and cheque bounce cases: The Metropolitan Magistrate Courts in Mumbai.
